DATED : 10.01.2018

CORAM

THE HONOURABLE MR.JUSTICE T.RAJA W.P.No.508 of 2018 T.Thirugnanam .. Petitioner -vs1. The Secretary to Government, Adi Dravidar and Tribal Welfare Department, Secretariat, Chennai-9.

2. The Director of Adi Dravidar Welfare, Chepauk, Chennai-5.

.. Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the 1st respondent to consider the petitioner's Appeal dated 07.12.2017 within a time fixed by this Court. For Petitioner :: Mr.D.Nagarajan For Respondents :: Mr.R.S.Selvam, Government Advocate

ORDER

The Writ Petition has been filed unnecessarily seeking to issue a Writ of Mandamus, directing the the 1st respondent to consider the petitioner's Appeal dated 07.12.2017, which was preferred against the order of reversion dated 20.11.2017 passed by the 2nd respondent within a time fixed by this Court.

2.

Heard the learned Counsel for the petitioner and the learned Government Advocate who takes notice on behalf of the respondents. 3.

It appears that against the order of reversion dated 20.11.2017 passed by the 2nd respondent, the petitioner has preferred an appeal before the 1st respondent only on 7.12.2017. While so, it is not known how the petitioner can approach this Court seeking to issue a Writ of Mandamus, directing the 1st respondent to consider the petitioner's Appeal dated 07.12.2017 as though there is any inaction on the part of the 1st respondent. The Writ of Mandamus is maintainable if there is any inaction or failure on the part of the respondents. But in this case, against the order of punishment, the petitioner after preferring an appeal on 7.12.2017 without giving any time to dispose of the same, approached this Court seeking Mandamus. Therefore, the present Writ Petition is not maintainable.

4.

In the result, the Writ Petition is dismissed. No costs. 10.01.2018 Speaking/Non speaking order Index : yes/no
