The case was earlier adjourned to 10.09.2019, 12.09.2019 and thereafter 20.09.2019. the case under the caption 'for dismissal' on 23.09.2019. On perusing the records on 24.09.2019 it was noticed that the appellants have not taken any steps to implead the legal heirs of the deceased/first respondent.

Therefore, the Civil Miscellaneous Appeal is dismissed for nonprosecution with liberty to restore the same. No costs.
