This petition has been filed to call for the records in Crime 1/4

No.188 of 2023 on the file of the first respondent and quash the same. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side).

3.On carefully reading the F.I.R., it is seen that the car number has been noted as TN 05 CB 1515. This car is said to have come to a halt by applying sudden brake and as a result the two wheeler that was driven by the petitioner dashed on the back of the car and the petitioner sustained injuries. Hence, the petitioner was taking steps to make a claim under the Motor Vehicles Act. The complaint was given by the wife of the petitioner. While registering the F.I.R., due to inadvertence, the car number was noted and whereas the accused was identified as the driver of the two wheeler instead of the driver of the four wheeler. Aggrieved by the same, the present criminal original petition has been filed before this Court.

4.It is clear from the complaint that the allegation has been made only as against the car and the car driver. Therefore, an alteration report shall be filed by the respondent Police before the concerned Court by showing the registration number of the car and the 2/4

driver of the car as the accused. This exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.

5.This criminal original petition is disposed of with the above directions. Consequently, the connected miscellaneous petition is closed.
