O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 430 and 379 of IPC r/w Sections 21(1) of Mines and Minerals (Development and Regulation) Act 1957 in Crime No.635 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 12.09.2020 the petitioner had illegally transported 1/2 unit of sand by using Bullock Cart without any valid permission. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. On instruction, he would further submit that the petitioner is prepared to deposit some considerable amount to any charitable organization or association without prejudice to his contention and prayed for grant of anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner had illegally transported 1/2 unit of sand by using Bullock Cart without any valid permission. He would submit that the respondent police seized the said Bullock Cart with 1/2 unit of sand. He further submitted that one previous case is pending against him hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
