O R D E R
The present Criminal Original Petition has been filed seeking a direction to the third respondent police to register a case pursuant to the order passed by the learned Judicial Magistrate No.II, Kallakurichi, in Crl.M.P.No.2435 of 2025, on 15.12.2025.
The case of the petitioner is that since no action was taken by the respondent police on his complaint dated 14.07.2025, he filed a petition under Section 175(3) of the BNSS before the Judicial Magistrate Court No.II, Kallakurichi, in Crl.M.P.No.2435 of 2025. The learned Judicial Magistrte No.II, Kallakurichi, vide order dated 15.12.2025, directed the Investigating Officer to investigate the matter and register a case if a prima facie case was made out or otherwise to file a report regarding the investigation conducted by him. However, till date, there has been no progress in the case. Hence, the present petition has been filed. Learned Government Advocate (Criminal Side), on instructions, submitted that based on the directions issued by the learned Judicial Magistrate No.II, Kallakurichi, the third respondent police conducted an enquiry and finding that a cognizable offence was made out, 2/4
registered a case in Crime No.7 of 2026 on 08.01.2026, for the offence under Sections 296(b), 115(2), 351(3) and 304(2) of the BNS. 4.
Recording the submission made by the learned Government Advocate (Criminal Side), this Criminal Original Petition stands closed. 12.01.2026 ham To 1.
