ORDER
This petition has been filed to direct the respondents 1 & 2, to provide adequate police protection to Electricity department officials concern while shifting the high power tension wire from petitioner agriculture land to other place by considering the representation of the petitioner dated 04-012022 pending on the file of respondents 1 & 2, in accordance with law.
2. The petitioner is the owner of the agricultural
land bearing Survey No.237 measuring about 143 Ares situated in Kozhiyur Village, Thittakudi Taluk, Cuddalore District. A high power tension wire passes over the petitioner's agricultural land and electricity polls are installed in his land which is obstructing the petitioner agriculture activities. Hence the petitioner requested for shifting high power tension wire from his land, which was permitted, the petitioner also paid shifting charges of Rs.1,93,500/- to the Tamilnadu Electricity Board on 13.05.2021 vide receipt No.081-04/21-362. The third respondent who is a petition monger and trouble shooter, of the local area threatened the Electricity Board Officials, and obstructed shifting of the electricity polls. He expects consideration which petitioner refused. Hence the third respondent is threatening the Electricity Board Officials.
The Electricity Board Officials informed the petitioner that unless arranges adequate police protection they will not be in a position to carry on the shifting work. The petitioner produced the revenue records, further Thittakudi Town Panchayath "No Objection Certificate" for payment of shifting charges to Electricity Board, the petitioner's request to the Superintendent of Police on 04.01.2022.
3. The learned Additional Public Prosecutor submitted that the petitioner sent a representation through Registered Post. The petitioner to appear before the second respondent Police along with the copy of the representation and necessary documents, the same would be considered. If there is no other valued objection, the high power tension wire can be shifted and the respondent Police would give necessary protection to the Electricity Board Officials.
4. In view of the same, the petitioner shall appear before the second respondent Police along with the copy of the representation and necessary documents. Thereafter, dates to be fixed for shifting work with electricity authorities and others. The respondent Police to provide necessary protection and carry out the shifting work without any obstruction.
5. With the above direction, this Criminal Original Petition is disposed of.
