PRAYER : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the third respondent not to harass the petitioner and her family members on the basis of the complaint dated 02.01.2022 given to the second respondent.

O R D E R

This Criminal Original Petition is filed to direct the third respondent not to harass the petitioner and her family members on the basis of the complaint dated 02.01.2022 given to the second respondent.

2.The grievance of the petitioner is that the petitioner had sent a complaint through registered post on 02.01.2022, no action has been taken. On the contrary, the third respondent Branch Manager, IDFC is harassing the petitioner to settle the loan borrowed by the petitioner's husband. The husband of the

petitioner got affected by COVID and passed away on 07.05.2021. She has to make arrangement in repayment of the said loan. In the mean time, the third respondent is causing harassment to the petitioner to repay the loan. Hence the present petition is filed.

3.The learned Additional Public Prosecutor submits that the petitioner's complaint has not been received by the respondent police. Further he submits that the grievance of the petitioner is that the private respondent i.e. the third respondent is harassing the petitioner, who is none other than the Branch Manager of IDFC Bank, who had extended loan to the petitioner's husband. To verify the veracity of the complaint, the petitioner to appear before the respondent police. Thereafter the respondent police would take appropriate action. 4.The learned counsel appearing for the petitioner on instruction submits that the petitioner shall appear before the respondent police on 03.02.2022, along with the copy of the complaint.

5.In view of the same, the petitioner is directed to appear before the respondent police on 03.02.2022, along with the copy of the complaint and the necessary documents in support of her contention. Thereafter, the respondent police is directed to take appropriate action in the manner known to law. 6.With the above directions, this Criminal Original Petition stands disposed of.
