Respondent/ Complainant Prayer:- This Criminal Original Petition is filed under Section 439(1)(b) of Cr.PC to modify the condition of suspension of sentence order in Crl.MP.No.6194/2019 in Criminal Appeal No.105 of 2019 dated 03.12.2019 passed by the learned Principal District and Sessions Judge at Thiruvallur and to reduce the deposit amount to 10% from 20% of cheque amount and to permit to deposit the said amount in six equal monthly instalments before the Trial Court.

ORDER

1.This Criminal Original Petition has been filed, to modify the condition of suspension of sentence imposed by the Principal District and Sessions Judge, Tiruvallur, by order dated, 03.12.2019, made in Cr.MP.No.6194 of 2019 in Crl.A.No.105 of 2019 to the extent that the Petitioner shall deposit 10% of the cheque amount, instead of 20% of the cheque amount. 2.Heard both sides.

3.Considering the submissions of the learned counsel on either side and the facts and circumstances of the case, the condition of suspension of sentence imposed by the Principal District and Sessions Judge, Tiruvallur, by order dated, 03.12.2019 made in Cr.MP.No.6194 of 2019 in Crl.A.No.105 of 2019 that the Petitioner shall deposit 20% of the cheque amount is modified to the extent that the Petitioner shall deposit 10% of the cheque amount within a period of two weeks from the date of receipt of a copy of this order.
