O R D E R

This petition has been filed challenging the order passed by the Court below, dismissing the petition filed by the petitioner under Section 91 of Cr.P.C to send for certain documents sought for by the petitioner.

2. The petitioner is the complainant in the private complaint filed against the respondents for an offence under Section 405 of IPC.

3. The case was at the stage of examination of witnesses and at that point of time, the petitioner filed the petition to call upon the Indian Overseas Bank, to furnish certain documents, viz., the statement of accounts which are maintained in the name of three persons in different account numbers.

4. The Court below after considering the entire materials available on record gave a categorical finding that these https://hcservices.ecourts.gov.in/hcservices/

documents are totally irrelevant for the purpose of deciding the case and there is no requirement to produce those documents as sought for by the petitioner.

5. Heard the learned counsel for the petitioner and the learned counsel appearing on behalf of the respondent.

6. The Court below has given cogent reasons, while dismissing the petition filed by the petitioner and this Court does not find any illegality or infirmity in the order passed by the Court below. There are absolutely no grounds to interfere with the order passed by the Court below.

7. In the result, this Criminal Original Petition is dismissed and the Court below is directed to complete the proceedings in S.T.C.No.57 of of 2013, within a period of two months from the date of receipt of a copy of this order.
