PRAYER:

Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus to call for the records of the respondent proceeding No.K1/862/2018 dated 21.02.2018 published in daily thanthi on 22.02.2018, which is reposted on 16.03.2018 through notice published on 08.03.2018 and quash the same directing the respondent to fix a date for fresh auction after publishing proper notice for running of small petty shops of an area of 8' x 6' in Salem New Bus Stand.

ORDER

Mrs.K.Bhuvaneswari, the learned Standing Counsel takes notice on behalf of the respondent. By consent, the Writ Petition is taken up for disposal at the admission stage itself.

2. This Writ Petition has been filed challenging the auction notice issued by the respondent dated 21.02.2018.

3. The case of the petitioner is that the respondent issued a notification dated 21.02.2018, calling tender for running a small petty shop in the platforms at Salem New Bus Stand. As per the said notification, 09.03.2018 was fixed for opening the tender, but before that on 05.03.2018, by an affixture at the https://hcservices.ecourts.gov.in/hcservices/

notice board of the Sooramangalam Ward Office, the tender was cancelled and to the surprise of the petitioner, another notice dated 08.03.2018 has been issued to open the tender on 16.03.2018.

4. The grievance of the petitioner is that when he approached the respondent for submitting his tender documents on 05.03.2018, it was informed that it cannot be done, as the tender notification dated 21.02.2018 was cancelled. So, if the tender is opened now, he would be prejudiced.

The learned Standing Counsel for the respondents submitted that the construction of shops in the Salem New Bus Stand has not yet been completed, so the respondent has no proposal to go ahead with the auction notification dated 21.02.2018 and only after issuing fresh notification, the respondent would conduct auction for running the shops in the Salem New Bus Stand.

6. Recording the submission of the learned Standing Counsel, the writ petition is closed as no further adjudication is necessary. No costs. Consequently, connected miscellaneous petitions are closed.
