O R D E R

The petitioner, who was arrested and remanded to judicial custody on 15.10.2025, for the alleged offence punishable under Sections 302, 120B, 294(b), 149, 351 of IPC r/w 4 of TNPHW Act, in Crime No.201 of 2023, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he was involved in a case of murder and was earlier arrested and released on bail. Subsequently, 1/4

during the pendency of the committal proceedings, he jumped bail; hence, a Non-Bailable Warrant (NBW) was issued against him on 15.06.2024. The warrant was later executed on 15.10.2025. Since the petitioner had continuously absconded, a Look-Out Circular (LOC) was issued, and when the petitioner attempted to go abroad, he was detained on the strength of the LOC, and the NBW was thereafter executed on 15.10.2025.

3. Learned counsel appearing for the petitioner submitted that the petitioner has now been arrested, the case has been committed to the Sessions Court, and the matter is pending for trial. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl. Side) appearing for the respondent submitted that the petitioner had earlier jumped bail, pursuant to which a Non-Bailable Warrant was issued on 15.06.2024. He further submitted that despite several steps taken to secure his presence, the petitioner did not appear, and subsequently, on the basis of the Look-Out Circular, he was detained at the airport and arrested on 15.10.2025. Hence, he opposed for the grant of bail to the petitioner.

5. Earlier, this Court dismissed the bail petition filed by the petitioner on 2/4

02.12.2025 on the ground that the petitioner is also facing another case under Section 302 IPC and if the petitioner is released on bail, there is a likelihood that he may again move for jumped bail.

6. Since there is no change in circumstances established before this Court to warrant reconsideration of the earlier order, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 09.01.2026 gv 3/4
