O R D E R
This Criminal Original Petition has been filed seeking for a direction to transfer the investigation from the respondent to some other investigating agency as there is not much progress in the investigation pending in Crime No. 902 of 2017 on the file of the respondent herein.
2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent.
3.Whenever any information in relation to commission of cognizable or non cognizable offence is received, the police officer shall adhere to the procedure contemplated under Sections 154 & 155 of the Criminal Procedure Code and after conducting necessary enquiry/investigation, file final report under Section 173 of Cr.P.C. Such investigation under Chapter XII of the Criminal Procedure Code shall be completed without any unnecessary delay. present case is inordinate and unjustified. Hence, it would be appropriate to direct the Investigating Officer to file a final report within a stipulated time, if not already filed.
4. Further, in my view, considering the facts of the case, it would be appropriate to direct the superior authority to monitor the investigation.
5. In the result, there shall be a direction to the respondent herein who is the Sub-Inspector of Police, Villupuram West Police Station, Villupuram, to complete the investigation in Crime No.902 of 2017 and file the final report within six weeks from the date of receipt of copy of this order. Such an investigation shall be monitored by the Deputy Superintendent of Police, Villupram.
6. In the result, the Criminal Original Petition is ordered with the above directions. No Costs.
