ORDER

This Writ Petition has been filed seeking the issuance of a writ of mandamus directing the 2nd respondent to remove the antennae, mobile Tower BTS equipment and other telecom equipment from the petitioner's land situated in S.F.No.545, admeasuring an extent of 3600 sq.ft situated at Malumichampaaty-Chettipallayam Road at Seerkonar Nagar, Coimbatore District, based on the petitioner's representation dated 15.11.2025.

2. It is the case of the petitioner that he is the absolute owner of land comprised in S.F.No.545 admeasuring an extent of 3600 sq.ft situated at Malumichampaaty-Chettipallayam Road at Seerkonar Nagar, 2/5

Coimbatore District. The petitioner had entered into a lease agreement with the 3rd respondent for installing an overground mobile tower and the lease period commenced on 22.06.2010. The lease rentals were paid only up to 14.11.2017. Further, the 3rd respondent had stopped maintaining the mobile tower and since then, it has been in a dilapidated condition. Components and electrical equipment from the tower have been falling down, posing danger to the public and passers-by. On 08.05.2020, due to lack of security and maintenance, two thieves had stolen a transmission booster and three copper wife with a combined value of Rs.70,000/-. A complaint was registered on the same day before the Chettipallayam Police Station. The petitioner thereafter sent a detailed representation dated 15.11.2025 to the 2nd respondent, highlighting the danger posed by the mobile tower to the general public. However, the 2nd respondent has neither replied to the said representation nor taken any action thereon. Hence, the petitioner has filed this writ petition seeking the relief stated supra.

3. Heard the learned counsel on either side and perused the materials available on record.

Considering the limited request of the petitioner and also taking into of the fact that the petitioner's representation dated 15.11.2025 has not been considered to date, the 2nd respondent is directed to consider and dispose of the petitioner's representation dated 15.11.2025, on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this order.

5. Accordingly, this Writ Petition is disposed of. No costs. 22.01.2026 srn To
