Prayer : Civil Revision Petition filed under Section 25 of the Tamil Nadu Buildings (Lease and Rent Control) Act 1960, praying to set aside the decree and judgment passed on 15.11.2021 in RCA.No.233 of 2016 on the file of the learned VII Judge, Court of Small Causes at Chennai, confirming the order and decretal order in RCOP.No.681 of 2013 dated 26.02.2016 passed by the learned XV Judge, Court of Small Causes, Chennai. ORDER

This revision is preferred by the tenant, who challenges the order of eviction concurrently passed both by the Rent Controller as well as the Rent Control Appellate Authority under Section 23 of the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960.

2. When the matter came up for admission on 12.04.2022, the learned counsel for the tenant submitted that some negotiation talks have commenced among the parties, and that the tenant has voluntarily agreed to vacate the tenancy premises.

3. Today, the tenant has filed an affidavit voluntarily, wherein he has undertaken to vacate the premises within a period of six months from today. The said voluntary undertaking of the revision petitioner/tenant is recorded, and the affidavit is also recorded and taken on file. The tenant is stated to have made a deposit of Rs.50,000/- to the respondent, and this is required to be repaid, to which, the landlord undertakes to repay the same, at the time when the keys are handed over to him. 2/4

4. Accordingly, the revision is disposed of, directing the revision petitioner/tenant to vacate the premises within a period of six months from today, and, the landlord is directed to pay the advance amount to the tenant, at the time when the keys are so handed over to him.
