ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 385 and 506(i) of IPC in Crime No.552 of 2021, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant is a BJP Functionary. During the lockdown, he has involved in social work and at that time, one Madurai Bala demanded money from his as mamool. At the confession statement of one arrested persons Poochi @ Velu Sadraak, the respondent police implicated the above said crime. Hence the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.
4. The learned Additional Public Prosecutor submitted that 3 previous cases pending against the petitioner, out of which 2 previous cases 302 cases, even as per the case of prosecution they attempted to kidnap the person in order to grab the money. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the facts and circumstances of this case, on seeing the approximate antecedent, this Court is not inclined to grant anticipatory bail to the petitioner.
