Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the respondents herein to consider and pass orders on merits and in accordance with law on the petitioner's representation dated 12.04.2013 regarding inclusion of his name in the panel of Assistant Director of Industries and Commerce (Industrial Cooperatives) Department for the year 2011-2012, in the light of G.O.(D).No.81 MSME (EII-1) Dept. dated 15.06.2012 within a time frame as deem fit.

The relief sought for in the present writ petition is to direct the direct the respondents herein to consider and pass orders on merits and in accordance with law on the petitioner's representation dated 12.04.2013 regarding inclusion of his name in the panel of Assistant Director of Industries and Commerce (Industrial Cooperatives) Department for the year 2011-2012, in the light of G.O.(D).No.81 MSME (EII-1) Dept. dated 15.06.2012 within a time frame as deem fit.

2. The learned Government Advocate appearing for the respondents submitted that the present writ petition has become infructuous since the petitioner's name was included in the panel to the post of Assistant Director (Industrial Cooperatives) for the year 2011-12 and he was promoted as Assistant Director (Industrial Co-operatives). He further submitted that the petitioner's seniority has also been revised as requested by him vide the second respondent's Proceeding No.255931/ICE2/2012 dated 18.11.2013.

3. In view of the submission made by the learned Government Advocate appearing for the respondents, nothing survives in the petition for further adjudication and therefore, this Writ Petition is dismissed as infructuous by this Court.
