ORDER
Apprehending arrest in connection with Crime No.239 of 2024 registered for the offences punishable under Sections 296(b), 118(1), 329(4), 351(3) of BNS and r/w Section 3 of Tamil Nadu Public Property Prevention of Damage Act, 1992, the present petition has been filed seeking anticipatory bail.
2. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He 1/4
further submits that the petitioner is no way connected to the offence as alleged by the prosecution. He also submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.
3. The case of the prosecution as putforth by the learned Government Advocate (Crl. Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that the petitioner and other accused had destructed the CCTV and Monitor of TASMAC Bar run by the defacto complainant and they also threatened the defacto complainant. He would submit that this is the second anticipatory bail application filed by the petitioner, as the earlier bail petition in Crl.O.P.No.28637 of 2024 was dismissed by this Court on 22.11.2024. He would also submit that the petitioner has eight previous cases pending against him.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and perused the materials available on record.
5. Considering the gravity of offence committed by the petitioner, and that the bad antecedents of the petitioner and the fact that there has been no 2/4
change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
