O R D E R
Challenging the fair and final order passed in I.A.No.238 of 2016 in O.S.No.322 of 2004 on the file of the Additional District Court, Namakkal, the plaintiff has filed the above Civil Revision Petition. 2.The plaintiff filed an application in I.A.No.238 of 2016 to issue subpoena to the Komarapalayam Municipal Commissioner. 3.The Trial Court allowed the application on payment of cost of Rs.1,000/-. Against the imposition of cost of Rs.1,000/-, the present Civil Revision Petition has been filed by the plaintiff. So far as the payment of cost is concerned, it is the discretion of the Court and this Court has no reason to interfere with the discretion exercised by the Trial Court. 4.Since the suit is pending from 2004, the Trial Court is directed to dispose of the suit within a period of six months from the date of receipt of copy of this order.
5.With these observations, the Civil Revision Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. Index : No 24.03.2017 Internet : Yes Gsa To The Additional District Court, Namakkal.
