ORDER
This Writ Petition has been filed seeking issuance of writ of mandamus, directing the third respondent to consider the petitioner's representations dated 20.09.2023 and 03.09.2025 given for treat the petitioners application number SI2022-10112 dated 29.11.2022, applied for the post of Sub-Inspector of Police, under the Economically Weaker Section (EWS) Community based on Economically Weaker Sections Certificate dated 14.08.2023.
2. By the consent of the learned counsel appearing on either side, this Writ Petition is taken up for disposal at the admission stage.
3. Learned counsel appearing for the petitioner would submit that the 3rd respondent issued notification on 08.11.2022 for fill up the post of of SubInspector of Police. The petitioner applied to the SI post on 29.11.2022 under the OBC certificate since the EWS certificate was getting delayed. Later, the petitioner obtained EWS certificate on 14.08.2023 from the fourth respondent and it was submitted to the 3rd respondent on 20.09.2023. Thereafter, the recruitment was dropped due to the candidates challenged for age relaxation and __________Page 2 of 6
other reasons. Thereafter, the 3rd respondent issued second notification on 12.08.2025 with instruction that those candidate applied to the earlier notification dated 08.11.2022 need not apply again. Hence, the petitioner again gave a representation on 03.09.2025 requesting his application to be considered under the EWS category. Thereafter, the 3rd respondent called for the certificate verification through phone and in response to the called for, the petitioner produced all the originals including EWS Certificates and requested to consider his application under the EWS category. Thereafter, the petitioner downloaded his application on 29.12.2025 wherein the community remain unchanged as OBC category. Though the petitioner gave representations dated 20.09.2023 and 03.09.2025, the third respondent did not consider the same and kept the petitioner under OBC category. Since the petitioner is suffering as he is not considered into EWS category, hence this writ is filed for appropriate orders.
4. Learned counsel appearing for the petitioner would submit that this Court may issue a direction to the respondents to consider the petitioner's representation dated 03.09.2025 and pass appropriate orders within a specified time.
5. Learned Additional Government Pleader appearing for the respondents would submit that the respondents will consider the petitioner's representation dated 03.09.2025 and pass appropriate orders within a period of four weeks. __________Page 3 of 6
6. In view of the same, the 3rd respondent is directed to consider the petitioner's representation dated 03.09.2025 and pass appropriate orders on the same, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
