ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 379, 430 IPC r/w Section 21(1) of Mines and Minerals (Development and Regulations) Act 1957 in Crime No.494 of 2018, seeks anticipatory bail.

2. The case of the prosecution is that on 01.11.2018, the Sub Inspector of Police attached with the respondent police and other police official party attached with other police stations have conducted raid to prevent the illegal transportation of river sand as per the orders of the Deputy Superintendent of Police, Nagapattinam. At about 5.30 am., one person came by a two wheeler, on seeing the police party, the said person abandoned the vehicle and attempted to ran away; the police party had apprehended the said person. At that time Four wheeler namely Ashok Leyland Dost was coming; on seeing police party the person who were driving the lorry and others attempted to escape, but the police party apprehended them. On checking the vehicle, it is found that the vehicle fully loaded with river sand. On enquiry, it is came to know that the lorry belongs to the petitioner and the other persons have committed theft of river sand from Kaduvai River. 3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Additional Public Prosecutor submitted that the petitioner is having history sheet. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case, the petitioner is having history sheet, this Court is not inclined to grant anticipatory bail to the petitioner.
