ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 336(2), 336(3), 340(2), 256 and 318(4) of the Bharatiya Nyaya Sanhita, (BNS), 2023, in Crime No.182 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner, who was working as an employee in Neyveli Lignite Corporation, allegedly obtained a "No Objection Certificate" fraudulently with the help of a Head Constable. Hence, this case.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence as alleged. This is the third anticipatory bail application, the earlier application in Crl.O.P.No.30410 of 2024 was dismissed on 09.12.2024. He also submitted that the petitioner is also willing to provide solvent sureties and abide with any conditions that may be imposed by this Court. Therefore, he prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Crl. Side) appearing for the respondent police opposed for grant of anticipatory bail to the petitioner, stating that the petitioner allegedly obtained the "No Objection Certificate" (NOC) fraudulently with the assistance of the Police Head Constable, who is the accused/A1 in this case. He further submitted that there are 6 previous cases as against the petitioner.

5. Heard the learned counsel for the petitioner, the learned Government Advocate (Crl. Side) appearing for the respondent police and perused the materials available on record.

6. Considering the gravity of the offence and that the petitioner has six previous cases pending against him and taking note of the fact that there is no change in circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner.
