PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the 1st respondent to consider the petitioner's appeal dated 11.08.2025 expeditiously after affording a personal hearing to the petitioner and consequently direct the 2nd and 3rd respondents to restore the name of the petitioner in Patta No.23 for the property being Dry land measuring an extent of 25-Kuzhi in R.S.No.63/3, Cadastre No.1582 3/3pt; and another property also being dry land measuring an extent of 50-Kuzhi and 07-Vesam in R.S. No.63/2 Cadastre No.1582 3/3pt, with farm house, situated in Pillaichavady village, Oulgaret Commune (Taluk), Puducherry.

ORDER

This writ petition has been filed seeking for a limited relief. The petitioner seeks for early disposal of the petitioner's appeal dated 11.08.2025, pending on the file of the 1st respondent.

2.Aggrieved by the order of the 3rd respondent, the petitioner has referred the aforesaid appeal dated 11.08.2025 before the 1st respondent. 3.Mr.Vasantha Kumar, learned Government Advocate (Puducherry) accepts notice on behalf of the respondents 1 to 3.

4.No prejudice would be caused to the respondents if a direction is issued to the 1st respondent to dispose of the petitioner's appeal dated 11.08.2025, within a time frame to be fixed by this Court, by hearing the objections of the private respondents 4 and 5 and by adhering to the principles of natural justice. 5.This Court is not expressing any opinion on the merits of the petitioner's appeal dated 11.08.2025.

6.Since no adverse orders are passed against the private respondents, notice to the respondents 4 and 5 is dispensed with by this Court in this writ petition.

7.For the foregoing reasons, this writ petition is disposed of by directing the 1st respondent to pass final orders on merits and in accordance with law on the petitioner's appeal dated 11.08.2025, after hearing the objections of the respondents 4 and 5 and any other third party, whom the 1st respondent deems it fit to enquire, within a period of eight (8) weeks from the date of receipt of a copy of this order, by adhering to the principles of natural justice.
