C.M.P.No.1634 of 2007 C.M.P.No.1634 of 2007 in C.M.A.No.453 of 1997 M.DHANDAPANI, J The C.M.P.No.1634 of 2007 has been filed seeking to set aside and restore the main C.M.A.No.453 of 1997 which was disposed of by this Court on 3.2.2004 and also to decide the impleading petition in W.M.P.No.4267 of 1999.

2. When this matter came up for hearing on earlier two occasions, i.e.

16.10.2023 and 18.10.2023, there was no representation on behalf of the appellant. In order to give one more opportunity, this Court has directed this matter to be listed today i.e., 20.10.2023 under the caption "For Dismissal".

3. Even today, when this matter is called, none appeared for the appellant. Thus, it shows that the appellant is not interested to prosecute this case any further. Hence, this C.M.P.No.1634 of 2007 is dismissed for nonprosecution.

4. In view of the dismissal of C.M.P.No.1634 of 2007, no further orders are required in C.M.P.No.4267 of 1999.

Accordingly, the C.M.P.No.4267 of 1999 stands closed.
