D. Jayarani v. Mr. N. Jayachandran
A.No.4524 of 2011 in O.P.No.838 of 2000 C.V.KARTHIKEYAN,J.
The matter is referred back to the learned Master for recording of evidence as directed earlier.
2.The petitioners in A.No.4524 of 2011 should appear before the learned Master on 17.10.2022 to lead evidence. 3.Thereafter, the learned Master may record evidence in manner known to law. While leading evidence, it must also be noted that the petitioner had filed A.No.2417 of 2022 to produce additional documents. That application had been allowed by a learned Single Judge of this Court on 11.08.2022.
4.Mr.T.Mathi, learned counsel for the respondent had raised an issue, since the application has been allowed, it should not give a carte blanche for all documents to be marked when produced as evidence. The normal restrictions of admissibility and the document being proved in manner known to law would still apply.
