THE HON'BLE MR.JUSTICE M.DHANDAPANI W.P.No.471 of 2019 V.Bharanidharan .. Petitioner Vs..

The General Manager, Erode District Co-operative Milk Producers Union Limited, Vasavi College Post, Erode - 638 316.

.. Respondent Prayer:

Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondent to consider the name of the petitioner for appointment on compassionate ground in any suitable post. For Petitioner : Ms.R.Poornima For Respondent : Mr.R.Balaramesh

O R D E R

The writ petition has been filed seeking a writ of mandamus, to direct the respondent to consider the name of the petitioner for appointment on compassionate ground in any suitable post.

2.

The learned counsel appearing on behalf of the writ petitioner made a submission that the father of the writ petitioner late K.S.Velusamy, was employed as driver in the office of the respondent and passed away on 01.03.2009, while he was in service. Soon after the death of petitioner's father, petitioner's brother one Arun Karthi immediately submitted application for appointment on compassionate ground. The petitioner was minor on the date of death of his father and hence the petitioner's elder brother submitted application for appointment on compassionate ground. In the meanwhile, the petitioner has attained majority. The petitioner's elder brother who had submitted application, left the house as he had marriage of his choice.

3.

However, an application seeking compassionate appointment was preferred by the writ petitioner in August, 2013 https://hcservices.ecourts.gov.in/hcservices/

with the respondent enclosing all the documents and the same was accepted by the respondent and called the applicant on 15.11.2018, for producing all documents. In compliance with the said order, the petitioner produced all the necessary documents. Thereafter, no communication was received from the respondent. Hence, the present writ petition has been filed.

4. The learned counsel for the respondent would submit that the respondent will pass appropriate orders on compassionate ground, if the petitioner satisfied the scheme. 5.

Considering the facts and circumstances, since the respondent agreed to pass order on the petitioner's application, I am inclined to issue direction to the respondent to pass appropriate order within a period of six weeks from the date of receipt of a copy of this order.
