Respondent in both CMAs/Respondent PRAYER : Appeals filed under Section 19 of the Family Courts Act against the order and decreetal order dated 08.10.2018 made in F.C.O.P.No.421 of 2014 & F.C.O.P.No.58 of 2016 on the file of Judge, Family Court, Vellore, Vellore District. For Appellant (in both CMAs) : Ms.M.Sangeetha For Respondent (in both CMAs) : Mr.S.Natana Rajan COMMON JUDGMENT (Delivered by M.M.SUNDRESH.,J) Both the appeals are preferred by the appellant, aggrieved over the decree for divorce and the consequential dismissal of the restitution of conjugal rights.
2. Today, the appellant, the respondent and the respective counsel are before us. Accordingly, the following terms are agreed upon:- (i) the appellant does not press the appeals filed and thus, the decree for divorce has become final;
(ii) the appellant does not press all the pending disputes between her and the respondent including M.C.No.21 of 2014;
(iii) henceforth, there will not be any claim between the appellant and respondent in any manner;
(iv) the respondent shall pay a sum of Rs.25,00,000/- (Rupees Twenty Five Lakhs only) in favour of the appellant by way of Demand Draft on or before 18.05.2020;
(v) the respondent shall return the cot and the utensils given by the appellant family in favour of the appellant within a period of four weeks from the date of receipt of a copy of this judgment;
(vi) till the compliance as aforesaid, the respondent shall pay a sum of Rs.15,000/- per month on or before first week of every month; (vii) the respondent shall have no liability over the minor child born out of the wedlock;
(viii) the respondent may be permitted by the appellant to see the child in her presence for about two hours once in a month, preferably the first week of the month, either Saturday or Sunday, at her place between 10.30 a.m. and 12.30 p.m. starting from the month of April, 2020;
(ix) there shall be decree to the aforesaid effect as agreed upon;
2. The Civil Miscellaneous Appeals stand disposed of. No costs. Consequently, connected C.M.P.No.22600 of 2018 is closed. Post this matter for reporting compliance on 05.06.2020. Sd/- Assistant Registrar(CS-III) //True copy// Sub Assistant Registrar ssm
