ORDER

This Writ Petition has been filed to direct the 1st respondent not to harass the petitioner and the employees of the organization, 'Triple EEE Connectors', in the premises No.130, I Floor, 5th Cross Street, Opp. Padayappa Complex, Gandhipuram, Coimbator for any enquiry pertaining to the refund of training and recruitment charges to the 2nd respondent herein.

2. The learned counsel for the petitioner submitted that the petitioner is the Managing Director of Triple EEE Connectors. The petitioner used to select candidates, according to the analysis of their education, personal traits, experience and expectations and if the candidate is fresher, without any previous work experience, the petitioner provides training in appropriate fields, for which the petitioner got charges, which is now being designed as money received for job. He further submitted that the petitioner is being called for enquiry by the 1st respondent Police and he was forced to settle the amount. Hence, he prayed for appropriate directions of this Court.

3. The learned Additional Public Prosecutor appearing for the 1st respondent Police submitted that on the promise of getting job, the petitioner collected huge sums of money from the job aspirants. Due to which, several persons are now in street. So far seven complaints have been received. For the purpose of enquiry on the complaints, the petitioner was called. He further submitted that the petitioner appeared before the 1st respondent Police on 13.11.2021 and promised to settle the issues. On the contrary, he filed the present petition.

On considering the submissions on either side, it is seen that several complaints have been received by the 1st respondent Police against the petitioner for committing the offence of job racketing. For that purpose only, the petitioner was called for enquiry by the 1st respondent Police, which cannot be termed as harassment.

5. In view of the above, this Court is not inclined to entertain this Writ Petition and the same is liable to be dismissed and, is dismissed. No costs.
