Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd Respondents herein to issue a fresh Patta for the lands situated at Survey Nos.151 and 152 of Thyaranadurgam Village, Thuppukanapally Post, Soolagiri Taluk, Krishnagiri District in Petitioner's favour by removing Survey Nos.151 and 152 of Thyaranadurgam Village, Thuppukanapally Post, Soolagiri Taluk, Krishnagiri District from the Patta No.158 based upon his representation dated 26.02.2020 and Letter dated 09.03.2020 addressed by the 2nd Respondent to the 3rd Respondent for 3rd Respondent's necessary action. ORDER

The petitioner has moved the Authorities concerned with his representation dated 24.02.2015, followed by the second representation dated 08.06.2017 for issuance of patta to him. The first of the representation was addressed to the Chairman, District Legal Services Committee. It appears, this has been forwarded to the third respondent/Tahsildar.

2.Mrs.R.Janaki, learned Additional Government Pleader takes notice for the respondents and made a statement on instructions that since the petitioner was away at Karnataka, the enquiry could not be promptly held and added that the enquiry is now scheduled to take place on 17.02.2021 at 3.00 p.m. at the office of the third respondent.

3.The said statement of the learned Additional Government Pleader is recorded.

4.In view of the above, no further direction is required to be given except that the third respondent is directed to issue notice to all the parties who are likely to be affected by his decision, provide them a fair and effective hearing and to dispose of the matter through a speaking order within a period of eight (8) weeks from the date of receipt of a copy of this order.

5.The Writ Petition is disposed of accordingly. No costs.

6.Post the matter for reporting compliance on 05.04.2021.
