ORDER

This petition is filed to call for records pertaining to the complaint pending in C.C.No.32 of 2015 on the file of the learned Judicial Magistrate No.1, Poonamallee. 2.When the matter was taken up on 22.02.2022, it was brought to the notice of this Court that the issue between the petitioners and second respondent had been settled and divorce by mutual consent was granted in H.M.O.P.No.425 of 2017 to the second respondent and the first petitioner.

3.It is also submitted that second respondent filed a consent affidavit consenting to quash the proceedings pending in C.C.No.32 of 2015 on the file of the learned Judicial Magistrate No.1, Poonamallee. Since, there was no representation to the second respondent, this matter was posted today. Today, Mr.A.Kumanaraja, learned counsel for the second respondent present and submitted that matter had been settled between the parties and nothing survives in this petition. 4.In view of the submission, also the fact that the issue between the parties had been settled and the second respondent has no objection and she consented the quash petition. Therefore, proceedings in C.C.No.32 of 2015 against the petitioners on the file of the learned Judicial Magistrate No.1, Poonamallee is quashed. In fine, Criminal Original Petition in Crl.O.P.No.17262 of 2015 is allowed and proceedings in C.C.No.32 of 2015 against the petitioners on the file of the learned Judicial Magistrate No.1 Poonamallee is quashed.
