Respondents PRAYER: This Civil Miscellaneous appeal is filed under Section 173 of the Motor Vehicles Act, 1988, praying to set aside the Decree and Judgment dated 24.08.2009 made in MCOP No.290 of 2008 on the file of the learned Subordinate Court / Motor Accidents Claims Tribunal, Pollachi.

JUDGMENT

The Civil Miscellaneous appeal has been filed to set aside the Decree and Judgment dated 24.08.2009 made in MCOP No.290 of 2008 on the file of the learned Subordinate Court / Motor Accidents Claims Tribunal, Pollachi.

2. Today, when the matter is taken up for hearing, the learned counsel appearing on behalf of either side reported that there was a settlement arrived between the parties for a sum of Rs.3,50,000/- as full quit. Accordingly, they have produced a receipt dated 11.01.2017 wherein it is stated that the respondents/claimants were receiving the amount of Rs.3,50,000/- by way of cheque drawn at Indian Overseas Bank, District Court Branch, Coimbatore. The learned counsel for the respondents also agreed the same. Accordingly, the matter was settled between the parties for a sum of Rs.3,50,000/- (Rupees three lakhs fifty thousand only) as full quit.

3. The first and second respondents are entitled to get Rs.1,25,000/- and Rs.2,25,000/- respectively from the full quit amount of Rs.3,50,000/- as per the order of the lower Court made https://hcservices.ecourts.gov.in/hcservices/

in M.C.O.P.No.290 of 2008 on the file of the learned Subordinate Court/Motor Accidents Claims Tribunal, Pollachi.

4. With the above direction, this Civil Miscellaneous Appeal is closed. Connected Miscellaneous petitions are also closed. No costs.
