J U D G M E N T

This Civil Miscellaneous Appeal has been filed by the Metropolitan Transport Corporation, Chennai to set aside the Award passed by the Tribunal in MCOP.No.4648 of 2005 by the Motor Accident Claims Trubunal, IV Judge, Small Causes Court, Chennai on 11.03.2008.

2. The learned counsel appearing for the appellant submitted that the respondent/claimant had also filed an appeal in CMA No.1020 of 2019 against the Award passed in MCOP.No.4648 of 2005 on 11.03.2008 by the Motor Accident Claims Trubunal, IV Judge, Small Causes Court, Chennai to enhance the compensation and the same was partly allowed on 11.02.2019 by this court by enhancing the compensation and hence, nothing survives for further adjudication in this appeal.

3. Inview of the above, this civil miscellaneous appeal is dismissed as infructuous. No costs. The connected miscellaneous petition is closed.
