PRAYER: Criminal Original Petition filed under Section 439(1)(b) of Cr.P.C., pleased to modify the order dated 02.01.2023 made in Crl.MP.No.6170 of 2022 to deposit a sum of Rs.25,000/- to the satisfaction of Judicial Magistrate-I, Tambaram.

This Criminal Original Petition has been filed to modify one of the conditions imposed by the learned Principal Sessions Judge, Chengalpattu in Crl.MP.No.6170 of 2022 dated 02.01.2023.

2. Learned counsel for the petitioner submitted that the petitioner was granted bail by the learned Principal Sessions Judge, Chengalpattu in Crl.MP.No.6170 of 2022 dated 02.01.2023. He further submitted that the learned trial Judge, while granting bail to the petitioner, directed the petitioner to deposit a sum of Rs.25,000/-(Rupees Twenty Five Thousand only) into the account of the Judicial Magistrate No.I, Tambaram, concerned in Cr.No.882/2022 of Tambaram Police Station. He also stated that, since, the petitioner is working as a coolie and earning minimum wages, he was unable to mobilize the fund to comply with the imposed condition. Thereby, he seeks for modification of the condition.

3. Heard the learned counsel for the petitioner and the learned 2/6

Government Advocate (Crl.Side) for the respondent.

4. In view of the above submission, the condition imposed by the learned Principal Sessions Judge, Chengalpattu in Crl.MP.No.6170 of 2022 dated 02.01.2023, to deposit a sum of Rs.25,000/-(Rupees Twenty Five Thousand only), is modified as follows and the other conditions remains unaltered.

" the petitioner/accused is directed to deposit a sum of Rs.10,000/- (Rupees Ten Thousand only) into the account of the Judicial magistrate No.I, Tambaram, concerned in Cr.No.882/2022 of Tambaram police Station."
