ORDER
Apprehending arrest in connection with Crime No.463 of 2024, registered for the offences punishable under Section 8(c) r/w 20(b)(ii)(B), 22(a), 25 and 29(1) of NDPS Act, 1985 and Section 123 of BNS, 2023, the present petition has been filed seeking anticipatory bail.
2.Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this court. He would submit that he is no way connected with this case and he is ready to abide by any stringent condition that may be imposed by this Court. 3.The case of the prosecution as putforth by the learned Government
Advocate (Criminal Side) appearing for the respondent police, opposing for grant of anticipatory bail, is that the petitioner along with other 10 accused were in possession of 1.614 Kilograms of Ganja, 640 nos., of Tapentadol Tablets and 67 Nos. of Nitrazepam Tablets, 2 two-wheelers, 10 Cell-phones and a sum of Rs.93,000/-, on seeing the respondent police, they ran away from the scene of occurrence. Based on the confession of the arrested accused, the petitioner herein has been implicated in this case. He would further submit that the petitioner has got three previous cases, out of which one case is similar in nature. 4.Having heard the learned counsel for the petitioner, and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record.
5.Taking into consideration the above facts and circumstances of the case and the submission made by the learned Government Advocate, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition stands dismissed. 20-01-2025 ah To 1.The Inspector Of Police, PEW., CBE City Police Station.
