ORDER
This Transfer Civil Miscellaneous Petition has been filed to transfer HMOP.No.818 of 2024 from the file of the learned II Additional Family Judge, Chennai to the file of Principal Subordinate Court, Kumbakonam 1/4
along with O.P.No.106 of 2024.
2.Heard the learned counsel for the parties.
3.Though in principle, without prejudice to the rights of the respondent/husband, the learned counsel for the respondent would submit that the respondent/husband has no serious objection for transfer, he would however take exception to the various allegations which have been made in the transfer petition. Hence, he would submit that, without admitting to any of those allegations, which according to the respondent are false and vexatious, the respondent has no objection for the transfer petition being ordered as prayed for.
4.I have also gone through the affidavit filed in support of the transfer petition.
5.Admittedly, there is connected OP.No.106 of 2024 pending before the Principal Sub Court, Kumbakonam and therefore, it would be in the interest of the parties that OP.818 of 2024 is withdrawn from the file of the II Additional Family Court, Chennai and transferred to the file of the 2/4
Principal Subordinate Court, Kumbakonam, to be tried along with O.P.No.106 of 2024. Considering the fact that the matters are now being going to be tried by only the Subordinate Court, Kumbakonam, the physical presence of the respondent/husband shall not be insisted upon by the Subordinate Court, Kumbakonam, for all hearings. 6.The Transfer Civil Miscellaneous Petition is allowed accordingly. There shall be no order as to costs. Connected Civil Miscellaneous Petitions are closed.
