The petitioner / wife has come up with the above transfer petition, seeking to withdraw H.M.O.P.No.346 of 2023 from the file of Principal Sub Court, Kancheepuram and transfer the same to the file of Sub-Court Judge, Sankari.

2. Though respondent entered appearance through counsel and name of the counsel is duly shown in the cause list, there is no representation for respondent today. Hence, I have proceeded to hear the learned counsel for the petitioner. I have also gone through the affidavit filed in support of the request for transfer.

3. The learned counsel appearing for the petitioner would submit that the respondent husband has filed a petition for divorce in H.M.O.P.No.346 of 2023 on the file of Sub-Court, Kancheepuram but the petitioner is living with her parents at Salem and it would be extremely difficult for her to attend each and every hearing by travelling nearly 335 kms by incurring huge amount.

4. I am satisfied that the petitioner has made out good ground for transferring the case and it is just and necessary to transfer the case in H.M.O.P.No.346 of 2023 pending on the file of the Sub-Court, Kancheepuram to the file of the Sub-Court, Sankari. 2/4

Accordingly, this Transfer Civil Miscellaneous Petition is allowed and the case in H.M.O.P.No.346 of 2023 is withdrawn from the file of the Principal Sub-Court, Kancheepuram and transferred to the file of the SubCourt, Sankari. Considering the facts, there shall be no orders as to costs.
