ORDER

The petitioners were arrested and remanded to judicial custody on 11.11.2025 for the alleged offence punishable under Sections 296(b), 115(2), 118(1), 311 & 351(3) of BNS in Crime No.339 of 2025, registered on the file of the respondent police, seeks bail.

2. The allegation against the petitioners is that they went to the petrol bunk where the defacto complainant was working and assaulted him using a fire extinguisher and a chair kept there, thereby causing severe injuries. Hence, a complaint was lodged and the petitioner was arrested.

3. Learned counsel appearing for the petitioners submitted that the petitioners are falsely implicated in this case only for statistical purposes and for their continued detention. He further submitted that the petitioners are in judicial custody since 11.11.2025. Hence, he prayed to grant bail to the petitioners.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the first petitioner has having 10 previous cases and the second petitioner has 5 previous cases pending against them. He further submitted that the injured sustained grievous injuries and was admitted in the Government Hospital, and based on his complaint, the present FIR came to be registered. Hence, he opposed to grant bail to the petitioners.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions made by the learned counsel on both sides, the nature of the allegations and the fact that the petitioners have bad antecedents, this Court is not inclined to grant bail to the petitioners. 2/4
