ORDER

Counsel for the petitioner is present. There is no representation for the respondent.

2. The learned counsel for the petitioner/wife submits that minor daughter is living with her and they are staying at Pallikaranai. The respondent has filed G.W.O.P.No.400 of 2025 before Family Court, Tirunelveli. After divorce, the petitioner is stated to have married and working at a Private Company in Chennai. Learned counsel further submits that since Tirunelveli is situated 400 kilometers away from Chennai, she is finding it difficult to travel from Chennai to Tirunelveli to attend the court proceedings along with the child. Considering the welfare of the wife and children, the learned counsel requests to transfer the GWOP from the file of Family Court, Tirunelveli to Family Court, Chennai.

3. Notice was served on the respondent but none appear for the respondent.

4. The learned counsel for the petitioner furthermore submits that as on date, the respondent is also employed at Chennai, therefore, transferring the case will not cause any prejudice to the respondent also. To that effect, learned counsel referred to respondent's profile at page No.20 of the typed set of papers, 2 / 4

a perusal of which goes to show that the respondent is employed at Chennai.

Considering the fact that the child is aged about 9 years and that the petitioner is residing at Pallikaranai, Chennai, this court is inclined to withdraw the GWOP.No.400 of 2025 from the file of Family Court, Tirunelveli to District Court, Chengelpet. On receiving the case papers, the District Court, Chengelpet, is directed to issue notice and after hearing both sides, dispose of the case in the manner known to law, within four months thereafter.

6. This Tr.CMP., is disposed of with the above direction. No costs. Consequently, connected CMP is closed.
