O.P.(Com.Div.)SR.No.2408 of 2023 ABDUL QUDDHOSE.J., This application has been filed, seeking to condone the delay of 29 days in filing the petition in D.No.2408 of 2023 under Section 34 of the Arbitration and Conciliation Act, to set aside the arbitral award dated 03.09.2022.
2. The arbitral award dated 03.09.2022 has been passed against the petitioners in favour of the respondents, which is put to challenge by the petitioners. There is a delay of 29 days in filing the petition under Section 34 of the Arbitration and Conciliation Act. One of the petitioners viz., the third petitioner, is a permanent resident of the United States of America. According to the petitioners, there was a delay in obtaining the power of attorney from the third petitioner and only due to the said reason, this application came to be filed, seeking for condonation of delay of 29 days.
3. Learned counsel for the respondents has also not raised any serious objection for allowing this application. This Court is also satisfied with the 1/3
reasons stated in the affidavit filed in support of this application.
4. Accordingly, this application is allowed as prayed for. Registry is directed to number the petition in Arb. O.P.(Com.Div.)SR.No.2408 of 2023 if the same is otherwise in order and list the same for admission. 02.08.2023 ab 2/3
