This application is filed to condone the delay of 227 days in filing the written statement in C.S.No.256 of 2019.

2. I heard the learned counsel for the applicant and the learned counsel for the first respondent/plaintiff.

3. The learned counsel for the applicant submitted that the applicant was suffering from illness and also received the documents only on 16.12.2019. Therefore, he prayed that the delay should be condoned.

Upon considering the submissions of the learned counsel for the respective counsel and on examining the affidavit filed in support of the application, I am of the view that the applicant has made out a case to condone the delay of 227 days in filing the written statement. Accordingly, this application is allowed by condoning the delay of 227 days in filing the written statement.

At the request of the learned counsel for respondents 1 to 5, list O.A.No.1058 of 2019 on 18.02.2020.
