J U D G M E N T
When the suit came up on 02.01.2017, there is no representation for either side. The Registry was directed to issue notice to the defendants. Notice sent to Defendants 1 and 4 returned unserved with an endorsement dated 20.01.2017, "vacated the premises".
2. The Plaintiff/Bank filed a memo dated 09.01.2017, before the Registry on 25.01.2017, stating that the parties approached the Bank and settled the claim amount. Therefore, the Bank prays for dismissal of the suit, as settled out of Court. The said memo is also recorded.
3. In view of the memo dated 09.01.2017, the above suit is dismissed as settled out of Court. No costs. 13.02.2017.
