ORDER

The petitioner, who was arrested and remanded to judicial custody on 18.12.2025, for the alleged offence punishable under Section 108 of BNS Act, 2023 in Crime No.661 of 2025 on the file of the respondent police seeks bail. 1/4

2. The allegation against the petitioner is that he is the husband of the deceased. The marriage between the petitioner and the deceased was solemnised on 13.03.2023. After the marriage, it is alleged that the petitioner took away the jewels of the deceased and frequently quarrelled with her after consuming liquor, thereby subjecting her to harassment. It is further alleged that the petitioner stabbed the father of the deceased in respect of which a separate case was registered and the petitioner was remanded to judicial custody. It is alleged that even thereafter, the petitioner continued harassment, the deceased is stated to have gone to her house, consumed acid and died. Hence, a case was registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 18.12.2025 and that he has not abetted the deceased to commit suicide. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that R.D.O. report is awaited. He further submitted that the petitioner had continuously harassed and assaulted the deceased, which resulted in humiliation and forced her to commit suicide. He further submitted that the petitioner has two previous cases against him. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

Considering the nature of allegation levelled against the petitioner, the fact that the petitioner not only subjected the deceased to continuous harassment but also stabbed the father of the deceased, and that the petitioner is also having two previous case, this Court is not inclined to grant bail to the petitioner.
