.. Respondent Petition filed under Section 11 of Contempt of Courts Act, 1971 to punish the respondent herein for his wilful disobedience and noncompliance of the orders of this Court made in Crl.O.P.No.7997 of 2017 dated 24.04.2017 under the provisions of the Contempt of Courts Act.

ORDER
By filing Crl.O.P.No.7997 of 2017, the petitioner sought for a direction to the respondent to file final report within a stipulated time frame. When the said Criminal Original Petition came up for hearing on
24.04.2017, the same was closed recording the submission made by the learned Additional Public Prosecutor that the case in Crime No.422 of 2014 has been investigated and closed as "mistake of fact" and that the closure report has also been filed before the concerned Court. 2.Now this contempt petition has been filed by the petitioner stating that the submission made by the learned Additional Public Prosecutor on 24.04.2017 while disposing the Crl.O.P.No.7997 of 2017 that the case has been closed as "mistake of fact" is incorrect and the same attracts the provisions of the Contempt of Courts Act. 3.On notice, the learned Public Prosecutor appeared for the respondent today and fairly submitted that inadvertently the mistake has crept in for making such statement before this Court. He further submitted that now departmental proceedings has been initiated against the Sub-Inspector of Police concerned. He further submitted that an enquiry is ordered to be conducted in the case relating to Crime No.422 of 2014 pending on the file of the respondent, by the concerned Inspector of Police.
4.Recording the above statement made by the learned Public Prosecutor, the contempt petition is closed, with a direction to the
concerned Inspector of Police to complete the enquiry and file final report in Crime No.422 of 2014 pending on the file of the respondent, as expeditiously as possible.
