ORDER

This writ petition has been preferred seeking a writ of mandamus directing the respondents to approve the petitioner's appointment as B.T. Assistant (History) from the date of his appointment, i.e., 02.07.2012 instead of 18.08.2013 and confer all the consequential benefits.

The petitioner was appointed as B.T. Assistant in the third respondent school on 02.07.2012. In pursuance of his passing the Teachers Eligibility Test on 18.08.2013, his appointment was also approved from 18.08.2013 and on 30.04.2015, upon his reaching the age of superannuation, he was given

extension of service upto 31.05.2015.

However, according to the petitioner, his appointment as B.T. Assistant in the third respondent school should be approved from 02.07.2012, since, even as per the Government's decision, appointment of teachers in minority or non-minority schools should be approved from the date of their appointment itself, provided they pass the Teachers Eligibility Test before April 2017; hence, in this regard, he addressed a representation dated 07.05.2015 to the third respondent school to approve his appointment from the date of his initial appointment, who has also forwarded the same to the second respondent; but, till date, no orders have been passed confirming his appointment from 02.07.2012 and hence, this writ petition.

Today, when the matter was taken up for hearing, surprisingly, Mr. P. Sanjay Gandhi, learned Additional Government Pleader accepting notice for respondents 1 and 2, produced a copy of the communication dated 22.04.2017 addressed by the second respondent to the Government Pleader, Madras High Court, wherein, it is stated the petitioner's appointment has been approved from the date of his appointment, i.e., 02.07.2012. Since the petitioner's prayer in this writ petition has been granted, this writ petition is closed, taking on record, the aforesaid communication of the second respondent dated 22.04.2017, a copy of which is also furnished to the learned counsel for the petitioner across the Bar.
