Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, to call for the records of the 1st respondent made in proceedings in Na.Ka.No.1297/G1/2014 dated 16.03.2015 received by the petitioner on 18.03.2015 and consequential order made in proceedings in Na.Ka.No.1057/G1/2014 dated 16.03.2015 received by the petitioner on 20.03.2015 respectively and quash the same.

O R D E R

This Writ Petition, which is of the year 2015 came up for consideration before this Court on 25.06.2024. On the said date, the learned counsel for the petitioner, who is on record at that point of time, filed a memo stating that the learned counsel has given up vakalat and handed over the entire case bundle to the petitioner.

2. A learned Single Judge of this Court directed issuance of notice to the petitioner returnable by 11.07.2024, but notice is not served on the petitioner as on date. However, taking into consideration the fact that the petitioner himself has taken back the case file from the then learned counsel for the petitioner, it is the responsibility of the petitioner to see that proper appearance is entered on his behalf or to argue the matter in-person. There is no necessity to put the petitioner again on notice by this Court, as he is fully aware of the fact that he has taken back the case file from the previous counsel. Hence, this Court while directed the Registry to print the name of the petitioner in the cause-list, and to list the same under the caption "For Dismissal" by an order dated 06.08.2024.

2. Today, inspite of the matter being listed under the caption "For Dismissal", there is no representation for the petitioner either in the pre-lunch or post-lunch session.

3. In the light of the above, this Court is left with no other option except to dismiss the Writ Petition for non-prosecution. Accordingly, the Writ Petition is dismissed for non-prosecution. No costs. Connected Miscellaneous Petition, if any shall stand closed.
