JUDGMENT

It is seen from the records that the fifth respondent died long back and till date no steps have been taken by the appellant to implead the legal heirs of the deceased fifth respondent. On several occasions this matter was posted under the caption "for dismissal". Even today, there is no representation on behalf of the appellant.

2. In view of the same, this Second Appeal is dismissed for non prosecution. No costs.
