ORDER

This Civil Revision Petition has been filed to call for the records relating to the fair and decreetal order passed in I.A.No.01 of 2022 in H.M.O.P.No.138 of 2022 dated 08.07.2025 on the file of the Sub-Court, Tiruchengode and pass such further or other orders as this Court deem fit.

2. The respondent herein filed I.A.No.01 of 2022 in H.M.O.P.No.138 of 2022 on the file of the Sub-Court, Tiruchengode, seeking interim maintenance. Upon hearing both sides, the Trial Court directed the petitioner to pay a sum of Rs.10,000/- per month towards interim maintenance and Rs.15,000/- towards litigation expenses. Challenging the same, the petitioner filed this Civil Revision Petition.

The learned counsel for the petitioner submits that the respondent deserted the matrimonial home barely two months after the marriage, without any valid cause and also the respondent is having source of income. However, considering the above fact, the Trial Court directed the petitioner to pay a sum of Rs.10,000/- as such is exorbitant. Hence, he prays to allow this petition.

4. Heard the submission of the learned counsel for the petitioner.

5. Considering the fact that the petitioner has not produced any record to show that the respondent is having source of income. However, considering the economic status of the petitioner, this Court is inclined to reduce the interim maintenance fixed by the Trial Court from Rs.10,000/- to Rs.8,000/- and petitioner shall pay the interim maintenance till disposal of HMOP proceedings.

Further, the petitioner is directed to pay the arrears within a period of 4 months from the date of receipt of a copy of this judgement, failing which, the petitioner is not entitled to proceed with the trial proceedings. Accordingly, the order passed in I.A.No.01 of 2022 in H.M.O.P.No.138 of 2022 by the Sub-Court, Tiruchengode, is set aside.
