ORDER
This writ petition has been filed seeking for a direction to the third respondent to survey and demarcate the property and issue patta, which according to the petitioner is owned by him, based on his representation dated 04.12.2025, within a time frame to be fixed by this Court.
2. The petitioner had submitted his representation dated 04.12.2025 for the aforesaid purpose. Since the same has not been considered till date, the petitioner has filed this writ petition.
3. Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents.
4. No prejudice will be caused to the third respondent if the said authority is directed to survey and demarcate the boundaries of the petitioner's property morefully described in the prayer to this writ petition, after hearing the objections if any from the neighbouring land owners as well as any other party as the third respondent deems it fit to enquire. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the third respondent is directed to issue notice to the neighbouring land owners and also to any other party, if the third respondent deems it fit to put on notice;
(b) After receiving objections if any and after considering the same, the third respondent shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order; (c) With regard to the second limb of prayer sought for by the petitioner, i.e. issuance of separate patta in the name of the petitioner is concerned, the petitioner will have to submit a separate representation, once survey and demarcation of boundaries is completed pursuant to the directions issued by this Court today;
(d) The third respondent shall also consider the said representation to be submitted by the petitioner, seeking for issuance of separate patta in his name of his portion of the property and pass final orders on the said representation as well within a period of eight weeks from the date when the Survey and demarcation has been done.
