The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences under Section 9(m) r/w 10 of POCSO Act registered in Crime No.85 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. It is the case of the prosecution that the victim child used to attend a tuition centre and it is stated that the petitioner had touched her body inappropriately in her private parts. The petitioner is aged about 55 years and the victim is aged just 11 years. The statement of the victim had been recorded under Section 164(5) of Cr.P.C. She had clearly stated about the sufferings she had undergone at the entire incident.

3. Therefore, I am not inclined to grant anticipatory bail to the petitioner.
