A.No.82 of 2022 in C.S.(Comm.Div.)No.124 of 2021 N.ANAND VENKATESH, J ., This application has been filed under Clause XII of Letters Patent Act, seeking for the leave of this Court to sue the respondent/defendant on the ground that a part of the cause of action has fallen within the jurisdiction of this Court.

2. When the other applications filed along with the suit came up for hearing on 03.01.2022, this Court pointed out to the learned counsel for the applicant that the facts of the present case may not strictly fall within the ambit of Section 134 of the Trademarks Act. In view of the same, by abundant action, the present application has been filed seeking for the leave of this Court.

3. This Court is convinced with the reasons assigned in the affidavit filed in support of the application and accordingly, this application is allowed and leave is granted.
