The petitioner / accused, who was arrested and remanded to judicial custody on 30.10.2023 for the offences punishable under Section 354(D), 366 of IPC and Section 6 of POCSO Act, 2012 in Crime No.08 of 2023, seeks bail.

2.The learned counsel for the petitioner stated that the petitioner had only spoken to the victim child and no other incident had happened and also pointed out the long period of incarceration suffered by the petitioner.

3.The statement recorded under Section 164(5) Cr.P.C., of the victim child had been perused by this Court. She had stated that on three separate occasions, the petitioner had committed the offence of sexual penetration on her. It is also stated that the petitioner had offered to marry her. Since he later refused, the victim who is just aged 14 years tried to commit suicide by drinking lizol.

smv 4.At this stage, taking into consideration the seriousness of the offence and the nature of statement given by the victim child, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
